1. Acceptance of Terms
BY ACCESSING OR USING BBAI ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must immediately discontinue use of the Service.
Continued use of the Service constitutes ongoing acceptance of these Terms, including any modifications we may make from time to time.
2. Service Description
BBAI provides AI-powered text and voice communication assistance to incarcerated individuals through sponsorship arrangements. Sponsors pay monthly subscriptions to enable access to our AI assistant for educational support, personal development, and communication.
Important Limitations:
- •This is NOT a monitored or crisis intervention service
- •We do NOT guarantee AI accuracy, appropriateness, or safety
- •We do NOT guarantee service availability or message delivery
- •Facility policies may supersede these Terms
3. User Accounts and Sponsorships
For Sponsors
- •You must be 18 years or older to create an account
- •You must provide accurate and complete information
- •You are responsible for maintaining account credential confidentiality
- •You are responsible for all activities under your account
- •Sponsorships are non-transferable without prior written consent
- •You will NOT have access to conversations between the sponsored individual and the AI
- •You represent that you have authorization to provide the sponsored individual's information
For Sponsored Individuals (Users)
- •Your use of the Service confirms acceptance of these Terms
- •You must comply with all facility rules and regulations
- •You are responsible for your use of the AI assistant
- •You acknowledge that your sponsor cannot see your conversations
- •You understand this is not a confidential or monitored service
4. Payment and Subscriptions
- •Sponsorship subscriptions are billed monthly at the rate displayed during checkout
- •All payments are processed through Stripe, our third-party payment processor
- •You authorize us to charge your payment method on a recurring basis
- •Cancellations take effect at the end of the current billing period
- •NO REFUNDS are provided under any circumstances (see our Refund Policy)
- •We reserve the right to change pricing with 30 days notice
5. AI Service Limitations and Disclaimers
THE AI ASSISTANT IS PROVIDED "AS IS" WITH NO GUARANTEES:
- •AI responses may be inaccurate, inappropriate, misleading, or harmful
- •AI-generated content is not medical, legal, financial, or professional advice
- •We do not guarantee any specific outcomes from using the Service
- •Content filtering is automated and imperfect - prohibited content may appear
- •Third-party AI providers may experience outages or errors
- •We are not responsible for actions taken based on AI interactions
Monitoring and Safety
- •We reserve the right to monitor and filter AI interactions for safety and compliance
- •Automated systems may flag conversations for prohibited content
- •We cannot guarantee intervention in emergency situations
- •If automated systems detect imminent harm, we may disclose information to authorities
- •Securus (our telephony provider) records all calls and may share with facilities
6. Prohibited Uses
You agree NOT to use the Service to:
- •Facilitate illegal activities or communications
- •Harass, abuse, threaten, or harm others
- •Violate correctional facility rules or regulations
- •Attempt to circumvent security measures or content filtering
- •Share account access with unauthorized individuals
- •Engage in any activity that disrupts or interferes with the Service
- •Reverse engineer, decompile, or attempt to extract source code
- •Use the Service in any way that violates applicable laws
7. Facility Policies and Conflicts
Correctional facilities have their own rules and policies that may affect your use of the Service:
- •Facility policies may conflict with or supersede parts of these Terms
- •Facilities may impose restrictions, monitoring, or content review
- •We will comply with lawful requests from facilities
- •We are not responsible for facility-imposed limitations or access denial
- •Service availability may vary by facility and is not guaranteed
8. Privacy and Data
We collect and process data as described in our Privacy Policy, which is incorporated into these Terms. Key points:
- •Communications may be monitored for safety and compliance
- •We cooperate with law enforcement when required by law
- •Data may be shared with correctional facilities as necessary
- •Third-party providers (Stripe, Securus, AI providers) process your data
- •Conversation data is retained for 90 days after cancellation, then anonymized
9. Intellectual Property
All content, features, and functionality of the Service are owned by BBAI and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our express written permission.
10. Disclaimers and Limitations of Liability
CRITICAL - READ CAREFULLY:
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY, AND INTEGRATION.
WE DO NOT WARRANT THAT:
- •The Service will be uninterrupted, secure, or error-free
- •AI responses will be accurate, appropriate, or helpful
- •Any defects will be corrected
- •The Service will meet your requirements or expectations
IN NO EVENT SHALL BBAI BE LIABLE FOR:
- •Any indirect, incidental, special, consequential, or punitive damages
- •Loss of profits, revenue, data, use, goodwill, or other intangible losses
- •Damages resulting from AI-generated content or advice
- •Damages resulting from facility actions or restrictions
- •Damages resulting from third-party provider failures
TOTAL LIABILITY CAP: Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless BBAI, its founders, officers, directors, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- •Your violation of these Terms
- •Your use or misuse of the Service
- •Your violation of any law or regulation
- •Your violation of any third-party rights
- •Any actions taken based on AI-generated content
12. Dispute Resolution and Arbitration
IMPORTANT - BINDING ARBITRATION CLAUSE:
YOU AGREE THAT ANY DISPUTE ARISING FROM THESE TERMS OR THE SERVICE WILL BE RESOLVED THROUGH BINDING ARBITRATION, NOT IN COURT. This means you waive your right to a jury trial and your right to participate in a class action lawsuit.
Arbitration Requirements:
- •All disputes must be resolved through individual arbitration
- •Arbitration will be conducted under the American Arbitration Association (AAA) rules
- •The arbitrator's decision is final and binding
- •You may not bring claims as part of a class action, consolidated action, or representative action
- •Small claims court is available for disputes under $10,000
Exceptions: This arbitration agreement does not apply to claims for injunctive relief to protect intellectual property rights.
Opt-Out: You may opt out of arbitration by emailing support@beyondbarsai.com within 30 days of first using the Service with subject line "Arbitration Opt-Out."
13. Termination
We May Terminate
- •We may terminate or suspend your account at any time for any reason, including violation of these Terms
- •No refund will be provided upon termination
- •We are not required to provide notice or explanation for termination
You May Cancel
- •You may cancel your subscription at any time through your account dashboard or by contacting Stripe Customer Portal
- •Cancellations take effect at the end of the current billing period
- •No refunds for partial months or unused service
Effect of Termination
- •Your right to use the Service immediately ceases
- •Data retention follows our Privacy Policy (conversation data retained 90 days, then anonymized)
- •All provisions that should survive termination (liability limitations, indemnification, arbitration) remain in effect
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- •Update the "Last updated" date at the top of this page
- •Notify you via email or through the Service
- •Your continued use after changes constitutes acceptance of the modified Terms
- •If you do not agree to changes, you must stop using the Service
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Subject to the arbitration agreement in Section 12, any disputes shall be resolved in courts of competent jurisdiction.
16. Miscellaneous
- •Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- •Waiver: Our failure to enforce any right does not waive that right
- •Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and BBAI
- •Assignment: You may not assign these Terms; we may assign them freely
- •No Agency: Nothing in these Terms creates a partnership, joint venture, or employment relationship
